In the following Terms and Conditions:
“Business” shall mean “Philip Yale Equine and Dog Photography”;
“Client(s)” shall mean “You” the Parties booking the services of The Business;
“Event” shall mean the Event title, usually (but not exclusively) a 2-hour portrait photoshoot;
“Photographer(s)” shall mean The Business or “Philip Yale”;
“Products” shall mean any USBs, albums or other items purchased by the Client;
“Supplier” shall mean any 3rd-party company chosen by The Business to print and manufacture The Products offered for sale to The Client.
“Services” shall mean photography to be carried out at the Event and any other Services agreed between the Client(s) and the Photographer;
Any photo sessions booked with The Business are subject to the following terms:
Copyright of all images belongs to The Business. The Clients appearing in these pictures, or any other persons also appearing in them, acknowledge that they have no rights to those images or to their use, without the express permission of The Business.
Images of The Client and their animal(s) may be used for promotional purposes.
Any images which include children under the age of 18 will not be used for any other purpose than display on the private gallery associated with The Event without the permission of the child’s parent or guardian.
The Business accepts no responsibility for injury or damage caused to horse, rider, property or any individual before, during or after The Event. If you choose, at your own discretion, to ride your horse without a riding hat, boots, or similar protective clothing, you do so entirely at your own risk.
During The Event, the Client(s) is/are responsible for the behaviour and actions of their pets/animals. The welfare of the animals in the photo session remains the highest concern. The session may be suspended or cancelled (to be rescheduled) altogether should the animals show signs of unease, discomfort or other adverse physical or emotional condition.
A condition of participating in The Event is that The Client releases and discharges The Business from any and all claims and demands arising out of, or in connection with, The Event, and subsequent use of the photographs including, without limitation, any and all claims for libel or invasion of privacy.
The Photographer shall be granted artistic license in relation to the poses photographed and the locations used. Although every effort will be made to comply with the Clients’ requirements, the Photographer’s judgement regarding the location, poses and number of photographs taken shall be deemed correct and not subject to dispute.
Upon confirmation of a date for The Event, 50% of the fee will be due as a non-refundable deposit in order to reserve and secure the date.
The balance of payment must be received in full by the date of The Event. If payment is not made, The Business reserves the right to cancel The Event.
Booking deposits will only be refunded under exceptional circumstances at the discretion of The Business.
The fee for The Event cannot be refunded in the unlikely event that The Client elects not to purchase any resulting images.
No products will be ordered from The Supplier until The Business has been paid for those products in full.
Where payment is to be made by a third party, The Client(s) acknowledge that they shall remain responsible for any balance outstanding.
Once an order has been placed with The Supplier it cannot be cancelled, amended or refunded.
All print and presentation sizes quoted are approximate and subject to change at the discretion of the Photographer and may be subject to slight variation.
Whilst every effort will be made, the Photographer cannot guarantee exact colour matching and is not held responsible for any colour variations which may occur due to light and location variations.
Products will be delivered to The Client within a reasonable timescale once received from The Supplier.
The Business is not responsible for any production or delivery delays experienced by The Supplier or its associated carriers. In all cases, though, The Business will strive to minimise any inconvenience caused to The Client as a result of any such delays.
